Terms of service

The short version: we quote from a photo, the number is final once we've seen the boxes, you can walk away at any point, and we only buy supplies that are honestly yours to sell.

Who we are, and what this covers

Upstate Medical Exchange LLC is a South Carolina limited liability company. We buy surplus diabetic supplies from individuals for cash across Upstate South Carolina and Northeast Georgia.

These terms cover this website and any sale you make to us. By using the site or selling to us, you're agreeing to them. If you don't agree, please don't use the site — text or call and we'll talk instead.

We buy. We don't sell, and we don't advise

We are not a pharmacy. We do not dispense anything, we do not sell supplies to consumers, and nothing on this site is medical advice. If you have a question about using a product, ask your doctor or pharmacist.

We only purchase sealed, unexpired, retail-labeled supplies. We do not purchase items obtained through Medicare or Medicaid, or stolen or fraudulently obtained products.

Offers are estimates until we've seen the boxes

Any number we give you from a photo is an estimate based on what we can see in that photo. It is not a contract, and it is not a promise to buy.

The offer becomes final only when we've looked at the actual supplies in person. If they match the photo, the number holds. If they don't — a seal that's broken where we couldn't see it, a shorter expiration date, damage, a recalled lot — we'll tell you exactly what changed and give you a revised number.

You are free to say no at that point, or at any point. You owe us nothing for a quote, and there is never a fee. Neither of us is committed to anything until we've handed you the money and you've handed us the supplies.

What you're confirming when you sell to us

By selling supplies to us, you're telling us that, to the best of your knowledge: they're yours to sell; they were not obtained through Medicare, Medicaid, or any other government benefit program; they weren't stolen and weren't obtained by fraud or misrepresentation; they're sealed, unexpired, and haven't been tampered with, relabeled, or repackaged; and they've been stored normally — not frozen, not left in a hot car, not water damaged.

Ownership passes to us when we pay you.

Texting and calling

When you text or call us, you're asking us to reply — so we will, using the number you contacted us from. That's the only thing we use it for.

We do not send marketing or promotional texts, and we don't add you to any list. If that ever changes, it will be something you opt into, not something you have to opt out of.

You can tell us to stop contacting you at any time: reply STOP, or just say so in plain words and we'll honor it. Your carrier's standard message and data rates may apply — that part is between you and them.

The site itself

We keep this site as accurate as we can, but prices, the list of what we buy, and availability all change. Nothing here is a guaranteed price or a binding offer.

The site is provided as-is. We don't warrant that it will always be available or error-free. If it's down, text or call — a person will handle it with you directly.

Limits on our liability

To the fullest extent the law allows, our total liability to you for anything arising out of a sale or this site is limited to the amount we paid you for the supplies involved.

We're not liable for indirect or consequential losses. Some states don't allow limits like this; if yours doesn't, this applies as far as your state permits and no further. Nothing here limits liability for fraud or anything else that can't legally be limited.

Trademarks

Dexcom, FreeStyle, FreeStyle Libre, Omnipod, Tandem, Medtronic, Accu-Chek, Contour Next and OneTouch are trademarks of their respective owners. Upstate Medical Exchange LLC is not affiliated with, endorsed by, or sponsored by any of them. We reference these names only to describe the supplies we buy.

Changes, and the law that applies

We may update these terms as the business changes. The date at the bottom tells you when they were last touched. Changes apply going forward — never to a sale that's already happened.

These terms are governed by the laws of the State of South Carolina, without regard to its conflict-of-laws rules. Anything we can't work out between us goes to the state or federal courts located in Greenville County, South Carolina.
